Terms of Use (EULA)

1. Introduction

This End-User License Agreement ("EULA" or "Terms") is a binding legal agreement between you ("User", "you", or "your") and PetNoter ("we", "us", or "our") for the PetNoter mobile application ("App").

This Agreement governs your use of our mobile application, including all related documentation. By downloading, installing, accessing, or using the App, you acknowledge that you have read and understand this Agreement and agree to be bound by its terms.

If you do not agree to these Terms, please do not download, install, access, or use the App.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App for your personal, non- commercial purposes on a single mobile device that you own or control.

3. Subscription Terms

The App offers auto-renewable subscription options with the following terms:

• Subscription Options: PetNoter offers monthly and yearly subscription options, as well as a lifetime purchase option.
• Subscription Benefits: Subscribers can manage documents, record pet moments, export pet details, and manage unlimited pets.
• Pricing: Subscription prices are clearly displayed within the App before purchase.
• Billing: Payment will be charged to your Apple / Google ID account at confirmation of purchase.
• Auto-Renewal: Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Subscription Management: You can manage and cancel your subscriptions by going to your Apple / Google ID account settings after purchase.
• Free Trial: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

4. User Restrictions

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App
• Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App
• Remove, alter, or obscure any proprietary notice of PetNoter or its affiliates, partners, suppliers, or licensors
• Use the App in any way that violates any applicable local, state, national, or international law or regulation
• Use the App for any purpose that is harmful or prohibited by these Terms

5. User Data and Content

PetNoter is designed to help you manage pet records and related information. You retain ownership of all content you create, upload, or store within the App. You are solely responsible for the accuracy and appropriateness of all content you add to the App.

6. Privacy Policy

Your privacy is important to us. Our Privacy Policy, available at https://petnoter.com/privacy-policy/, explains how we collect, use, and protect your personal information when you use our App. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

7. Third-Party Services

The App may display, include, or make available third-party content (including data, information, applications, and other products or services) or provide links to third-party websites or services. You acknowledge and agree that we are not responsible for such third-party services or content.

8. Updates and Maintenance

We may from time to time, in our sole discretion, develop and provide App updates, which may include upgrades, bug fixes, patches, and other error corrections, or new features. Updates may also modify or delete certain features or functionality. You agree that we have no obligation to provide any Updates or to continue to provide or enable any particular features or functionality.

9. Termination

This Agreement is effective until terminated by you or us. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term of this Agreement. You may terminate this Agreement by deleting the App and all copies from your device. Upon termination of this Agreement, you shall cease all use of the App and delete all copies of the App from your device.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PETNOTER BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE APP.

12. Changes to this Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of your country of residence, without regard to its conflict of law provisions.
